Mr. Sandler (Chairman) called the meeting to order at 7:00 PM.
Continued Hearing - Residential Site Plan Approval
CASE PB#2004-07 - WALTER & MARY MAKAR, 60 Pleasant Street, Berlin, MA 01503, request Residential Site Plan Approval under Eastham Zoning By-Laws Section XIV to construct new two-story residential dwelling resulting in a Site Coverage Ratio exceeding 15% of the lot area for property located at 220 Pierce Road, Eastham, Map 04 Parcel 526.
Ben Zehnder (Attorney) submitted a request for withdrawal without prejudice for this case.
A MOTION was made by Mr. Cole, SECONDED by Ms. Morse to accept the request for withdrawal without prejudice. VOTE: 6-0 Unanimous (For: Sandler, Abbott, Cole, McDonald, Morse and Nightingale)
Mr. McDonald recused himself from deliberating on Case PB#2004-26
New Hearing - Residential Site Plan Approval
CASE PB#2004-26 - DAVID & ELLEN KAVAL, PO BOX 1233, Eastham, MA 02642, requests Residential Site Plan Approval under Eastham Zoning Bylaws Section XIV, to remove existing dwelling and construct a new single family house resulting in a Site Coverage Ratio greater than 0.150 for property located at 12 Bayberry Lane, Eastham, Map 13 parcel 171.
Tim Brady (Engineer/Surveyor) presented an over of the proposed project. Laurie Kunches (26 Bayberry Lane) expressed fairness concerns with projects over 0.150 being approved.

A MOTION was made by Mr. Cole and SECONDED by Mr. Nightingale to APPROVE - Site Plan Approval-Residential for CASE PB#2004-26 - DAVID & ELLEN KAVAL, PO BOX 1233, Eastham, MA 02642, under Eastham Zoning Bylaws Section XIV, to remove existing dwelling and construct a new single family house resulting in a Site Coverage Ratio greater than 0.150 for property located at 12 Bayberry Lane, Eastham, Map 13 parcel 171. VOTE: 4-3 In-Favor (For: Sandler, Cole, Klink, Nightingale / Against: Abbott, Morse and Salomone)
Mr. McDonald rejoined the Board.

CASE PB#2004-27 - CHRISTOPHER THOMPSON, 215-A Bayside Drive, Eastham, MA 02642,requests Residential Site Plan Approval under Eastham zoning Bylaws Section XIV, to construct a new single family home resulting in Site Coverage greater than 3,000 sq. ft. for property located at 75 Oquamoshod Road, Eastham, Map 04 Parcel 136.
Chris Thompson (Applicant/Builder) presented an overview of the proposed project. The Chair asked for public comment on this request and there was none.
A MOTION was made by Ms. Morse and SECONDED by Mr. McDonald to APPROVE - Site Plan Approval-Residential for CASE PB#2004-27 - CHRISTOPHER THOMPSON, 215-A Bayside Drive, Eastham, MA 02642, under Eastham zoning Bylaws Section XIV, to construct a new single family home resulting in Site Coverage greater than 3,000 sq. ft. for property located at 75 Oquamoshod Road, Eastham, Map 04 Parcel 136. New Hearing – Definitive Subdivision Plan
CASE PB#2004-28 - G. DONALD FIFE TRUST; JONATHAN D. & TIMOTHY H. FIFE, 4520 Sherwood Forest, Delray Beach, FL 33445, request Definitive Subdivision Plan Approval to reconfigure two existing lots (5.60 acres) into five lots (four new building lots) for property located at 125 & 145 Lawton Road, Eastham, Map 14 Parcels 48 & 52.
Peter Soule (Surveyor) presented an overview of the request for the proposed subdivision. Ellen Covell (205 Lawton Road) expressed concerns regarding existing flooding problems on Lawton Road. Peter Naylor (40 Heritage Hill Circle) raised concerns regarding exacerbating existing drainage problems on Heritage Hill Circle. Anne Macaulay (45 Heritage Hill Circle) asked about Lot 5 accessing property off of Heritage Hill Circle. Dave Crary (Board of Highway Surveyors) relayed the concerns of the BOHS that road should be built to Town standards and the objection to catch basins in the road layout. Mr. Soule went over the drainage system, its engineering certification and that Lot 5 would be accessed from Fife Court, as only legal access. The Board discussed the need for a Maintenance
Agreement for the proposed road and its ability to approve roads not fully meeting Town specification under the Rural Road Alternative specified in its Rules and Regulations.
CASE PB#2004-28 - G. DONALD FIFE TRUST (continued)
A MOTION was made by Ms. Morse and SECONDED by Mr. Nightingale to APPROVE – Definitive Subdivision Plan for CASE PB#2004-28 - G. DONALD FIFE TRUST; JONATHAN D. & TIMOTHY H. FIFE, 4520 Sherwood Forest, Delray Beach, FL 33445, to reconfigure two existing lots (5.60 acres) into five lots (four new building lots) for property located at 125 & 145 Lawton Road, Eastham, Map 14 Parcels 48 & 52 upon the Conditions: 1) Plan include note “Fife Court is not to be accepted as a Town Road”, 2) Covenant, 3) Maintenance agreement for Fife Court and 4) Final Approval from Board of Health. VOTE: 6-0 Unanimous (For: Sandler, Abbott, Cole, McDonald, Morse, and Nightingale)

CASE PB#2004-29 - ALAN & MARCIA RINGGOLD, Geneva, Switzerland, requests Residential Site Plan Approval under Eastham Zoning Bylaws Section XIV to remove existing dwelling and construct a new single family dwelling resulting in Site coverage greater than 3,000 sq. ft. for property located at 385-R Mary chase Road, Eastham, Map 18 Parcel 075.
Stephanie Sequin (Engineer) and John Ingwersen (Architect) presented an overview of the plan and pending hearing with the Conservation Commission. The Board discussed the Applicability of the Demolition Delay Bylaw for the dwelling. The Chair asked for public comment on this request and there was none.
A MOTION was made by Ms. Morse, SECONDED by Ms. Abbott to continue the hearing until the Board’s October 13, 2004 meeting. VOTE: 7-0 Unanimous (For: Sandler, Abbott, Klink, McDonald, Morse, Nightingale and Salomone)

CASE PB#2004-30 - ROBERT & EDIE LEKITES, 6816 Windham Parkway, Prospect, KY 40059, requests Residential Site Plan Approval under Eastham Zoning Bylaws Section XIV to remove existing dwelling and construct a new dwelling resulting in Site Coverage of greater than 3,000 sq. ft. for property located at 20 Boat Meadow Way, Eastham, Map 19 Parcel 013.
Stephanie Sequin (Engineer) and Peter Haig (Architect) presented an overview of the revised plans. Mitch Dobek (20 Sunset Avenue) asked about the location of the septic system and then reviewed the plan.

A MOTION was made by Mr. Nightingale and SECONDED by Mr. Cole to APPROVE - Site Plan Approval-Residential for CASE PB#2004-30 - ROBERT & EDIE LEKITES, 6816 Windham Parkway, Prospect, KY 40059, under Eastham Zoning Bylaws Section XIV to remove existing dwelling and construct a new dwelling resulting in Site Coverage of greater than 3,000 sq. ft. for property located at 20 Boat Meadow Way, Eastham, Map 19 Parcel 013 upon Conditions: 1) Board of Health Approval and 2) Conservation Commission Approval. VOTE: 5-1 In-Favor (For: Sandler, Abbott, Cole, McDonald, and Nightingale / Against: Morse)
New Hearing - Residential Site Plan Approval
CASE PB#2004-31 - MICHAEL LEE, 5 Nathaniel Swift Road, Eastham, MA 02642, requests Residential Site Plan Approval under Eastham Zoning Bylaws Section XIV, to remove existing dwelling and construct a new dwelling resulting in Site Coverage of greater than 3,000 sq. ft. for property located at 425 Great Pond Road, Eastham, Map 011 parcel 189.
Michael Lee (Applicant/Builder) presented an overview of the proposed project. The Chair asked for public comment on this request and there was none. The Board discussed the need to revise the plans and reconcile elevations and floor plans.
A MOTION was made by Ms. Morse, SECONDED by Mr. Nightingale to continue the hearing until the Board’s October 13, 2004 meeting. VOTE: 6-0 Unanimous (For: Sandler, Abbott, Cole, McDonald, Morse, and Nightingale)
Other Business
Good Luck Cottages – Bob Freeman (Surveyor) came into discuss a potential subdivision as an alternative to the recently endorsed ANR plan for the Good Luck Cottages site. The Board discussed the merits of waiving pavement requirements.
60 Carlton Way – Bill Reyburn (Designer/Builder) came in to discuss a proposed project informally with the Board.
Zoning Working Meetings – The Board set its next work session for September 29, 2004 @ 7:00 PM in Town Hall.
